At the beginning of a recent webinar titled “Want To Get An Edge On Appeals? This Data Can Help,” Anne Wise Kann, project manager at legal analytics firm Lex Machina, presents viewers with a scenario: 

“In our hypothetical, I’m an attorney and I’ve been hired by a big box electronic store. My client is being sued in the Northern District of Georgia because the plaintiff claimed a big box fell on them in the Atlanta store. And, the district court has already found that our client was negligent and has ordered a damage award in favor of the plaintiff. Now the client wants to figure out our next move. Should we appeal this ruling?”

There are a myriad of factors to consider here, but they’re tied to a search for clues as to how the appellate court might respond to an appeal.

Answering that question is where data-based investigations can give attorneys an edge when it comes to making potentially high-risk decisions.
