Keto ice cream maker seeks bankruptcy protection while appealing costly packaging judgment.

Rebel Creamery, a Utah-based company known for its keto-friendly ice cream, has filed for Chapter 11 bankruptcy protection while fighting a multimillion-dollar court judgment involving the design of its product packaging. The company filed the bankruptcy case August 14 in the U.S. Bankruptcy Court for the District of Utah. Court records show Rebel has about $13.78 million in assets and roughly $23.85 million in liabilities. The filing comes less than a month after a federal judge ordered the company to pay $23.785 million to Van Leeuwen Ice Cream following a long-running legal fight over packaging.

Rebel sells its ice cream through major retailers, including Walmart, Kroger and Safeway. The company has built its business around low-sugar and keto-friendly frozen desserts, giving it a place in the growing market for products marketed toward shoppers looking for lower-carbohydrate foods.

The legal dispute began in 2021, when Van Leeuwen accused Rebel of copying the appearance of its ice cream containers. The lawsuit focused on the overall look of Van Leeuwen’s packaging rather than the ice cream itself. U.S. District Judge Eric Komitee ruled that Rebel had copied and weakened the value of Van Leeuwen’s trade dress, which refers to the visual features that help consumers recognize a product or brand. The court found that the copying was intentional.

The packaging at issue featured several recognizable design elements, including single-color cardboard containers, matching lids, pastel shades, black script lettering and a simple overall appearance. The court found that the combination of those features had become associated with Van Leeuwen’s products.

Van Leeuwen had asked the court for $36.4 million based on Rebel’s profits. The judge awarded less than that amount, reducing the figure by about one-third. The ruling stated that some Rebel sales were likely connected to consumer demand for keto and health-focused ice cream rather than the appearance of the containers. Along with the financial award, the court ordered Rebel to stop selling products with packaging that could be confused with Van Leeuwen’s containers. The company was also ordered to change its packaging design.

Rebel has challenged the ruling and listed Van Leeuwen’s claim as disputed in its bankruptcy paperwork. The bankruptcy filing gives the company a chance to continue operating while the case and appeal move forward under court protection. Financial records included in the bankruptcy case show that Rebel reported about $5.22 million in cash and cash equivalents. The company also listed approximately $2.59 million in accounts receivable, which is money owed to the business, and about $5.65 million in inventory.

Rebel’s financial condition, along with the size of the judgment and the ongoing appeal, could all play a role in the decision. The company remains in business while the bankruptcy case proceeds, although its future will depend on the court case, its finances and the outcome of its appeal. For Rebel Creamery, the bankruptcy filing now adds another major legal and financial challenge to a packaging dispute that has already resulted in a judgment worth nearly $24 million.
